If a person over 16 is assessed as lacking capacity to consent to serious medical treatment or to a stay in a care home for more than 8 weeks or hospital for more than 28 days; AND they have no family or friends who it is appropriate to consult as to what might be in the persons best interests; they MUST be refered to the Independent Mental Capacity Advocacy (IMCA) service by the health or social care professional involved.
